Aligarh Muslim University (AMU) – Issue of Show Cause Notice Under Section 13(6) of the Aligarh Muslim University Act, 1920 Regarding Holding of the Meeting of the University Court on 19th December,

WHEREAS Sub-section (6) of the Section 13 of the AMU Act provides, inter alia, that the Visitor may, by order in writing, annul any proceeding of the University which is not in conformity with this Act, the Statutes or the Ordinances;

AND WHEREAS the proviso to Sub-Section (6) of Section 13 provides that before making any such Order, the Visitor shall call upon the University to show cause why such an order should not be made, and, if any cause is shown within a reasonable time, shall consider the same;

AND WHEREAS it has been brought to the notice of the Visitor by members of the Court of Aligarh Muslim University and other stakeholders that the meeting of the Court is scheduled to be held on 19th December, 2010 with important agenda to elect Chancellor, Pro-Chancellor, Treasurer and 6 representatives to the Executive Council of the University, without fulfilling the statutory requirement of the minimum notice period of 35 days;

NOW THEREFORE, the President of India, in her capacity as the Visitor of the University, in exercise of powers vested in her under Sub-Section 6 of Section 13 of the AMU Act, is pleased to direct that a show cause notice be issued to the University as to why the proceeding of the University to convene the meeting of the Court on 19th December, 2010 should not be annulled;

AND FURTHER THERETO, the Visitor has directed that until the University’s reply to this show cause notice is received and the decision of the Visitor in this regard is communicated, the University shall deep the decision to hold the meeting of the Court in abeyance.

The University shall bring this notice to the attention of all the members of the Court at once so as to avoid any inconvenience to them. The reply of the University to the notice shall be submitted to the undersigned within a period of 15 days for consideration of the Visitor.
