Question : NATIONAL JUDICIAL PAY COMMISSION



(a) whether the Government have finalised the odalities for implementation of the recommendations of he First National Judicial Pay Commission;

(b) if so, the details thereof;

(c) if not, the reasons therefor; and

(d) the steps taken by the Government for early implementation of the recommendations of the National dicial Pay Commission?

THE MINISTER OF LAW, JUSTICE AND COMPANY AFFAIRS AND MINISTER OF SHIPPING (SHRI ARUN JAITLEY):

(a) to (d) The First National Judicial Pay Commission (FNJPC) submitted its report in November,1999. 3. The matter relating to judicial officers including their conditions of service is primarily the concern of the State jiovernments/High Courts. The Commission has sent its recommendations to the Central Government, State overnments, UT Administrations and High Courts. The recommendations are under examination in so far as they relate to the Central Government, i.e. in regard to the Union territories only. The recommendations which relate to the State Governments are being examined by the State Governments.

The Supreme Court is also monitoring the implementation of the Report of FNJPC in W.P. No. 1022/ 1989 - All India Judges Association vs. UOl. The Registry of the Supreme Court of India, vide letter dated 25.7.2000, had asked the Central Government to indicate its views on the various recommendations of the Commission after co-relating the responses received from the State Governments. Accordingly, a counter affidavit alongwith summary of responses received from most of the State Governments has been filed in the Supreme Court of India.
