Question : CSR Spent in Uttar Pradesh

(a) whether the companies have spent any Corporate Social Responsibility(CSR) fund in Uttar Pradesh;

(b) if so, the details of the funds spent and activities undertaken by the public Sector Undertakings (PSUs), joint sector enterprises and private sector enterprises under the CSR for regional development in Uttar Pradesh during each of the last three years, company-wise;

(c) whether certain establishments have spent the CSR funds for the works other than regional development;

(d) if so, the steps taken by the Government to ensure utilisation of CSR funds as per the rules; and

(e) the list of all those corporate houses/firms/companies which are bound to follow CSR rules

(a) to (e): The Government provides the broad framework for Corporate Social Responsibility (CSR) through Section 135 of the Companies Act, 2013 (‘Act’), Schedule VII of the Act and Companies (CSR Policy) Rules, 2014. Section 135 of the Act mandates every company having net worth of Rs. 500 crore or more, or turnover of Rs. 1000 crore or more, or net profit of Rs. 5 crore or more during the immediately

preceding financial year to undertake CSR activities. Similarly, Schedule VII indicates the activities that can be undertaken by the companies as eligible CSR activities. These activities are broadly aligned with national priorities and related to inclusive and sustainable development such as health, education, poverty eradication, hunger, women empowerment, welfare of armed forces veterans, environment, sports, rural development, slum area development, welfare of weaker sections; disaster management etc. Further, the Ministry vide general circular no. 05/01/2014 dated 18.06.2014 clarified that the entries in Schedule VII are broad based and must be interpreted liberally. Under the Act, CSR is a Board driven process and the Board of the company is empowered to plan, decide, execute and monitor CSR activities of the company based on the recommendation of its CSR Committee. The CSR architecture is disclosure based and CSR mandated companies are required to file details of CSR activities annually in MCA21 registry. Whenever any violation of CSR provisions is reported, action against such non-compliant Companies are initiated as per provisions of Act after due examination of records and following due process of law. On the basis of filings made by the companies in the MCA21 registry, the CSR spent by various public and private sector companies in the State of Uttar Pradesh during the last three financial years are given below:
