Question : MARRIAGES TO OVERSEAS INDIANS



(a) whether the Government has any proposal to bring a law to regulate marriage of Indian women with an Overseas Indian;

(b) if so, the details thereof;

(c) whether the Supreme Court has also directed the Government to frame suitable rules and procedure for compulsory registration of marriages of all persons who are citizens of India;

(d) if so, the details thereof; and

(e) the action taken by the Government in this regard?

(a) & (b): No, Sir.

(c) to (e): Hon’ble Supreme Court vide judgement dated 14th February, 2006 in the case of Smt. Seema Vs. Shri Ashwani Kumar has held that marriages of all persons who are citizens of India belonging to various religions should be made compulsorily registrable in their respective states, where the marriage is solemnized . The Hon’ble court has also directed all the States to notify rules for registration of marriages. The Ministry has drawn the attention of all States/UTs to the judgement of the Supreme Court in the case of Smt. Seema Vs. Ashwini Kumar and has requested them to make rules for compulsory registration of marriages.
