Question : Rights and Safeguards of Minorities

a) whether the National Commission for Minorities (NCM) has looked into the specific complaints regarding deprivation of rights and safeguards of the minorities;

b) if so, the details thereof;

c) the number of complaints/hearings dealt with since the inception of the Sixth Commission;

d) the number of cases successfully disposed of since the inception of the commission;

e) the status of disposed of and pending cases received from the State of Telangana by the commission; and

f) the steps taken/being taken by the Government for timely disposal of complaints?

(a)&(b) The duties, functions and responsibilities of the National Commission for Minorities (NCM) are elaborated in the NCM Act, 1992. As mandated under Section 9 of the NCM Act, 1992, the Commission has been taking up cases regarding deprivation of rights and safeguards of the minorities, as and when they are brought to the notice of NCM, with the concerned authorities in the State Govt. and Central Government. Commission also takes suo-moto cognizance of cases of any violence against the minorities including visits to affected areas. The NCM is committed to various constitutional and statutory provisions relating to safeguarding the interests of minorities in India. Further, the Commission sends its recommendations to the State and Central Governments with regard to the protection of educational and economic upliftment of the notified minorities in the country.

(c) 13384 complaints were dealt and 88 hearings were held since the inception of Sixth Commission i.e. 2010-11.

(d) All the cases except 533 have been disposed of since the inception of Commission till 01.03.2016.

(e) 48 complaints were received and dealt and 04 complaints are pending from the State of Telengana till 01.03.2016.

(f) Whenever incidences of delay in timely disposal of complaints are brought to the notice of Ministry of Minority Affairs, the Ministry immediately writes to NCM to dispose of the complaints promptly under intimation to the Ministry. NCM takes up the matters with the concerned authorities and as per merit of the case, hearing is also held. Besides, Members and Senior Officers visit the State Governments to expedite the reply from the authorities in order to dispose of the cases.
