Question : Data Protection And Privacy

Will the Minister of Electronics and Information Technology be pleased to state:

(a) whether the United Nations (UN) has urged India to strengthen its data protection and privacy policies and if so, the details thereof;

(b) whether the Government has taken adequate steps to ensure data privacy of network users and If do, the details thereof;

(c) whether the Government proposes to enact a legislation for data privacy, strict cyber disclosure norms and curtailing security breaches and if so, the details thereof and the time by which the said legislation is likely to be enacted?

Answer given by the minister

(a): No, Sir.

(b): The government has issued the Information Technology (Reasonable security practices & procedures & sensitive personal data or Information) Rules 2011 which seeks to ensure the data privacy of the network users.

(c): Yes, Sir. The Government has constituted a Committee of Experts under chairmanship of Justice Shri B N Srikrishna, Former Judge, Supreme Court of India vide its Office memorandum number 3(6)/2017-CLES dated 31st July 2017. The committee’s work is in progress. The committee is in the final stages of preparing its report, & has been requested to submit a report on ‘Data Protection Framework’ as expeditiously as possible. On receipt of the report from the committee is received, steps will be taken thereafter to enact a suitable legislation.
